damaged newly leased car upon pick up at dealer

I just signed a lease agreement for a new 2019 audi premium plus Q5 and
when i went to pick it up at the dealer there were scratched all over the car
They say they are going to try to buff it out but I don't want to purchase a
brand new damaged car
Where do I stand legally on this ?
I did  not drive the car off the lot

You did the right thing not accepting the car. Have that lease canceled for that reason. If everything goes smoothly, you could lease another car from that dealer. If not, go somewhere else.

they are trying to convince me they have buffed it out and are clearly going to fight to let me out of the lease agreement

I don't know how bad the scratches were or if my understanding of how extensive they were is accurate, but I'd hate to begin a lease this way. If they buffed easily, they're not deep, and might not have gone past the clear-coat (you should find out). And if you take the car, have all this noted in the paperwork. My concern would be that when you turn the car back, they might say that excessive paint repair will cost you. If you are concerned, take this up with someone above the dealer at Audi and get an opinion from corporate. However this works out, if you do take the car, you should have a lot of documentation to protect you.

If they give you any grief about it just contact your local BBB and if that don't put a bug in their ear then the local DA certainly will.
