Didn't I have 7 days to return a car if i bought it online as advertised?

I purchased a car online, didn't I have 7 days to return it like it is advertised?
This is flat out fraud.  I was interested in a 2006 Mini Cooper. The pictures
looked good, it showed some ding marks, chips, some worn spots in the
interior and high mileage as expect for a car that age. I contacted the
dealership and asked if the car would pass an Emissions and Inspection
tests. The answer I got, "It should, we wouldn't let a car go if it couldn't."  I
then looked at the Carfax report, it didn't have any red flags on it.  I looked
on YouTube to see what common wear a Mini Copper that age might have,
so I expected a few wear items.  So I bought the car for $7995.00.  In
addition there was a $598.00 for a "Theft Deterrent" charge.  I asked about
this and I was told it is a device that tracks the car for 3 yrs. if it gets stolen.
Stupidly I let this go. I was also charged $800 for shipping.  The car was
delivered from Chicago to my home in PA.

When the delivery man pulled up in the Mini I instantly new I was had. The
car made such a loud sputtering noise it looked like something from a
cartoon. Looking at the car from the back, part of one rusty muffler was
hanging down almost touching the ground. I examined the other muffler and
it looked like swiss cheese full of rusty holes; that's the source of the
sputtering noise.  The driverside mirror was ducted taped on. I went to get
into the car on the passengerside but it wouldn't open. I looked under the
car, everthing was rusted. At once I said I did not want this pile of heap.  The
guy delivering the car said I owed $450 instantly even though on the Bill Of
Sale it included an $800 delivery fee that I paid.  The Dealership wasn't
opened yet so I couldn't proved that I already paid $800! So now I paid
$1200 in delivery charges for a rusted piece of junk!
I told the Dealership that according to CarGuru I have 7 days to return it.  But
they argued and wanted me to take it to a Service department to see what all
was wrong with the car.  $10,000 to get this car to pass Emmisions and
Inspection.  Then I get hit with $189 for the report.  The Dealership then said
that was rediculous and I agreed! The Dealership then said I could return it
and get a refund.  I spent $700 to deliver it back.  2 weeks go by not a word.  
I kept  sending emails, heard nothing.  Finally a different guy of the
Dealership answered the phone, he says that they said that "They would fix
it. Nowhere it says we have to take it back." After me yelling, he said "Well,
you will have to pay a 20% restocking fee."  I said fine because by now they
wore me down to a nub.  They sent me an email stating that I have to get
docked for $3,432.03 that means the whole experience cost me $4,771.03
for a $7995.00 car! I paid more than half the cost of a car that I do not own.
NEVER BUY A CAR FROM CARGURU!!!!!

Your fault, never buy site unseen, do research, if you had you would have known to not buy anything European in a used condition. Can’t fault CarGurus for your own mistakes.

Hi Bernie. Let me start by saying I'm very sorry for your misfortune!! Also, I don't represent Cargurus in any way. Cargurus is an advertising site only. Similar to Craigslist, Facebook Marketplace, etc. This could have all been avoided if you had spent a few hundred dollars and had a professional inspection company check the car over for you before you decided to buy it. I've used lemonsquad.com for my long distance purchases with excellent results. Getting a pre purchase vehicle inspection insures you know exactly what you're buying. You should never ever buy a vehicle sight unseen, especially an eighteen year old one!! I don't know what, if anything, you can do about this but I'd suggest talking to your local Office of Consumer Affairs. They may be able to help you. Let this be a learning experience for you and move on. Now that you know how not to buy a vehicle you can use this knowledge to make better decisions in the future. Good luck to you!! Jim
