Labor charge for part under warranty. Legal?

Good morning. I recently had the water pump replaced on my 2009 535ix. It was covered under manufacturer's warranty. It went out after 14 months and the shop first argued with me about the length of the warranty. After my boyfriend called autozone, gave the factory part # and was told it had a 24 month warranty the shop finally acknowledged the warranty. Anyway, they still charged me @$450 for labor. Is this legal? I was told by another shop that the labor would have been covered had I brought the car there. Can I sue?

If you purchased a part from an auto parts store that is warrantied for a length of time, and the part fails during that time period, they are only going to warranty the part, not the labor. You would have to have an extended warranty on your car to cover labor costs. It not the fault of of repair shop that a part fails. There out to make a living also.

A 2009 BMW will not be covered by a BMW warranty. Now if you had bought the part and labor the first time (the whole repair) from the BMW dealer you may have gotten it done again for free, but I doubt it. Most dealers warrant their repairs for 12 months or 12,000 miles from the date and mileage of the original repair whichever comes first. However, I believe that Autozone gives a lifetime warranty on almost everything. So if you bought the water pump from Autozone and still have the receipt and the box for the replacement water pump you can at least get your money back for that. But again, that's for the part only. Not the labor. HTH. -Jim
