transmission won't shift i have to shift down to 3rd then shift up to drive for it to change gears ?

It sounds like you are going into fifth and not going into forth when you are manually shifting from 3rd to drive. If there is a forth gear failure you may not automatically shift-up from third. You should have the transmission scanned for codes but it is most likely an internal transmission failure.
