CarGurus' Copyright Notice Policy

If you in good faith believe that your copyrights are being infringed by material on CarGurus' cargurus.com website, you may request removal of those materials (or access to them) from the website by following the procedure outlined below.

As per the U.S. Copyright Act (17 U.S.C. ยง512), you must email a notice to copyright@cargurus.com including the following information to put CarGurus on notice of the infringement:

  1. Identify the copyrighted work that you believed was infringed. If there are multiple works, send a list of such works;
  2. Identify the infringing material or activity and information that is reasonably sufficient to allow CarGurus to locate the material. Please submit links of the infringing material;
  3. Your contact information as the copyright owner or the authorized agent;
  4. A statement saying "I have good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;"
  5. A statement saying "The information in this notice is accurate, and under penalty of perjury, I am authorized to act on behalf of the copyright owner.
  6. The signature of the copyright owner or the authorized agent.

Once CarGurus is put on notice, CarGurus will take action on valid notice and takedown complaints and remove the infringing material from our site.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages (including costs and attorneys' fees).

Counter Notice Policy

If you believe that material you posted on the website was removed or access to it was disabled by mistake or misidentification, you may file a counter notification with us (a "Counter Notice") by submitting written notification to our copyright agent designated above. Pursuant to the DMCA, the Counter Notice must include substantially the following:

  • Your physical or electronic signature.
  • An identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
  • Adequate information by which we can contact you (including your name, postal address, telephone number, and, if available, email address).
  • A statement under penalty of perjury by you that you have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
  • A statement that you will consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside the United States for any judicial district in which the Website may be found) and that you will accept service from the person (or an agent of that person) who provided the Website with the complaint at issue.

The DMCA allows us to restore the removed content if the party filing the original DMCA Notice does not file a court action against you within ten business days of receiving the copy of your Counter Notice.

Please be aware that if you knowingly materially misrepresent that material or activity on the website was removed or disabled by mistake or misidentification, you may be held liable for damages (including costs and attorneys' fees) under Section 512(f) of the DMCA.

Repeat Infringer Policy

In accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable law, CarGurus will promptly take action, without notice, regarding an account that is determined by CarGurus, in its sole discretion, to be a "repeat infringer". In accordance with the Terms and Conditions of Use, CarGurus may also at its sole discretion limit a user's access to its sites and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
