Honda CR-V transmission

Driving on expressway something clicked seemed
Like something in street ran over had towed to
mechanic asked for price he told me it was trans to
me to call insurance they would take care of it then
he got total of $3900 from insurance did not go
where they said go got car back same day I called
and told him was not driving right he said drive for a
few days called him again because when at a stop
car would jerk or skip
To shift gear everything jerking skipping took it back
he said I needed  axile and mounts
For engine and transmission I paid him and car still
not working.
My question is before he installed transmission
shouldn’t he have checked to make sure that when
he does install it it worked.  If he knew axile was
bad should have said something before he put
transmission in correct.  Before ripping me off all
the money and saying that the insurance only paid
for him to install a transmission.  He also didn’t get
the trans from where the insurance told
Him too. I’m taking him to court please help

Most shops with certified techs test drive every vehicle and yes He had the axles out to change transmission if they were bad He could have put in a revised estimate to late now.
