There has to be more here, the ECM will dump the codes after about 10 or so cold starts, also if the ECM fuses are pulled for a few minutes. Is the dealer telling you that your ECM is not acknowledging the clear code command from their system checker?

Try the fuse removal, just make sure you remove all of the ECM fuses so it is reset back to factory. Then after that is done drive as you normally would, watch the check engine light, if it comes on it set a code, you can get it checked for free at most major parts stores. You may want to have it checked any way just verify the codes are cleared.
